DEFINITIONS:

The terms used in the Regulations mean:

  1. Client – a natural person, legal entity, or an organizational unit without legal personality, which has legal capacity under specific regulations, making an order via the online store, email, or telephone.
  2. Consumer – a natural person purchasing products via the online store, telephone, or email for purposes not directly related to their business or professional activity.
  3. Product – any item sold through the online store.
  4. Regulations – this document, including attachments, outlining the obligations and rights of both parties to the agreement.
  5. Online Store (Store) – the online service available at www.jdkpoland.pl, through which the Client can place orders.
  6. Goods – products presented in the Online Store.
  7. Sales Agreement – an agreement for the sale of goods concluded between the Seller and the Buyer via the Online Store.
  8. Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws 2014, item 827).
  9. Electronic Services Act – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
  10. Order – the Client’s declaration of intent aimed directly at concluding a Sales Agreement, specifying, in particular, the type and quantity of the Goods.

GENERAL PROVISIONS

  1. These Regulations define the terms of service provision by electronic means in accordance with the Act of July 18, 2002, on the provision of electronic services by JDK GROUP Sp. z o.o..
  2. The online store www.jdkpoland.pl allows placing orders via the Internet and fulfills them by postal or courier delivery only within Poland.
  3. Purchases in the store may only be made by adults with legal capacity.
  4. The products offered in the store are brand new, free of physical and legal defects, and have been legally introduced to the Polish market.
  5. To use the Store and place orders, the Client must have an active email account and a device (computer or tablet) connected to the Internet, meeting the minimum technical requirements: an up-to-date web browser such as Chrome, Internet Explorer, Mozilla Firefox, or Opera.

PLACING ORDERS

  1. Placing an order involves completing an order form available on the Store’s website and submitting it via the “Buy and Pay” button on the order summary page.
  2. Orders can be placed 24/7, seven days a week via the Internet. Orders placed on Saturdays, Sundays, and holidays will be processed on the next business day.
  3. A sales document is issued for each purchase and sent along with the order.
  4. All prices in the store include VAT and are listed in Polish zloty (PLN). The shipping costs are not included in the product prices and are displayed at checkout and in these Regulations.
  5. The order is only processed after the Client confirms their acceptance of these Regulations by selecting the relevant checkbox before submitting the order.
  6. The Client will receive an automatically generated order confirmation email, including product details, shipping method, payment information, total amount due, and an order number to be used for bank transfers or in case of in-person pickup.

ORDER PROCESSING

  1. Order processing starts:
    • For bank transfer and PayU payments – upon receipt of funds in the Store’s account.
    • For cash-on-delivery payments – upon order submission by the Client.
  2. All products are custom-made and shipped within 14 days of receiving payment, allowing time for production, packaging, and shipment preparation.
  3. If the Client needs to cancel an order, they must contact the Store via phone (660-741-820) or email (sklep@jdkpoland.pl). Orders can be canceled only if they have not yet been shipped. Custom-made orders cannot be canceled or refunded.
  4. Orders are delivered via Polish Post (Poczta Polska) or courier services to the address provided by the Client.
  5. The Store reserves the right to refuse order fulfillment in the following cases:
    • If payment is not received within 7 days of placing the order.
    • If the order form is incorrectly completed.
    • If the provided information is false or misleading.
    • If the Client fails to collect a cash-on-delivery shipment.
  6. In case of order cancellation by the Store, a full refund will be issued within two business days.
  7. If an order cannot be processed, the Client will be notified via email or phone within five business days.

SHIPPING COSTS

  1. The shipping cost depends on the order value, payment method, and delivery option and is displayed at checkout according to the pricing list on www.jdkpoland.pl.

PAYMENTS

  1. The Client can make payments via:
    • Bank transfer
    • Online payment gateway – PAYU
    • Cash on delivery
  2. The Store does not charge additional fees for the chosen payment method.
  3. For bank transfers, payment must be made within three days of placing the order.

RETURNS (WITHDRAWAL FROM A DISTANCE CONTRACT)

  1. The Store allows returns in accordance with applicable laws.
  2. Clients classified as Consumers under Article 22(1) of the Civil Code have the right to withdraw from a purchase agreement within 14 days of receiving the goods, without providing a reason.
  3. A withdrawal statement should be sent to: ul. Przemysłowa 5, 24-320 Poniatowa or sklep@jdkpoland.pl.
  4. The returned product must be sent back unused and in its original condition within 14 days of withdrawal.
  5. The Store does not accept cash-on-delivery returns.
  6. Any free gifts included with the purchase must also be returned.

FINAL PROVISIONS

  1. Matters not covered in these Regulations are governed by the Consumer Protection Act of March 2, 2000, the Civil Code, and the Act on Special Consumer Sales Conditions of July 27, 2002.
  2. These Regulations come into effect on December 1, 2020, and apply to all orders placed from that date.
